Yet, our hosts, Chris Shakib and Jessica Hall with Terrell Hogan Law, point out that this risk is only compounded by the many people who are severely underinsured or those who fall victim to the loopholes and pitfalls that insurance companies exploit to reduce the insurance benefits available or deny the claims.
Why is getting the coverage you need so confusing and complex? Learn more about what the right coverages you should have before you find out the hard way.
In today's episode, we peak into the ins and outs of auto insurance, particularly in Florida, - compliments of an enlightening conversation with Matt Carlucci, a well-known auto insurance agent and city council member in Jacksonville, Florida, and Sarah Johnson, a former client of Terrell Hogan. This insightful episode of Not Another TV Lawyer reveals the often-misunderstood aspects of auto insurance, including mandatory coverages, the concept of “full coverage,” and the importance of uninsured motorist protection.
Video time-stamps are available at the end of this blog in the Episode Notes.
One of the most significant issues discussed in Episode 1 of Not Another TV Lawyer is the concept of “full coverage.” Many people believe they have comprehensive protection when, in fact, they may only have the statutory minimum. According to Shakib, “Full Coverage” is a term often misused in advertising, leading to misconceptions.
"That's one of the things that's frustrating for me when clients come in and say they have full coverage because they think they're covered and they're not," said Shakib. "It's one of the biggest misnomers that I see in my practice."
Understanding auto insurance requires more than a cursory glance; it demands a thorough review and personalized advice to ensure adequate protection. Here are some of the key takeaways from the conversation:
In Florida, the statutory minimum provides Personal Injury Protection (PIP) and property damage liability. PIP covers the first $10,000 of medical expenses regardless of fault, while property damage liability covers damages caused to another person’s property. Our panel of experts point out the critical need to seek medical attention within 14 days post-accident to benefit from PIP.
"You have to have medical treatment within the first 14 days, stated Hall. "If not, unfortunately, your personal injury protection benefits will be capped at $2,500."
Carlucci highlights the importance of customizing insurance plans to fit individual needs and financial situations. He recommends starting with $100,000 per person and $300,000 per accident in liability coverage. For those with significant assets, higher limits and an umbrella policy provide additional protection.
He advises: “If you injure somebody, you want to make sure you have some liability coverage. I always recommend at least 100,000 per person, 300,000 per accident.”
Uninsured motorist (UM) coverage is another critical component. The experts stress the importance of UM coverage, which protects you if an uninsured or underinsured driver causes an accident. Many drivers are unaware of their underinsured status until it’s too late, making UM coverage invaluable. With the amount of risk on Florida roads, having uninsured or underinsured motorist coverage can help significantly to mitigate your risks if you are in an accident.
Auto insurance is more than a legal requirement; it’s a financial safeguard and a means of protecting yourself and others on the road. Misconceptions about terms like “full coverage” can leave you vulnerable, making it essential to understand your policy’s details. By consulting with experienced professionals like Carlucci and ensuring adequate coverages, you can navigate the complexities of auto insurance with confidence and peace of mind.
Stay informed, stay protected, and always ensure your insurance covers not just the minimum requirements but the unexpected events life might throw your way.

Introducing the Hosts

Chris began his career fighting for victims’ rights as a state prosecutor of violent criminals. From 1992 to 1996, he prosecuted bad guys and witnessed the life-long harm criminals inflicted on their victims, because they made a conscious decision to do wrong, often for financial gain. As a partner at Terrell • Hogan, Chris advocates for those injured or killed by medical malpractice – including women injured in an alleged breast implant warranty scheme – defective drugs, defective medical devices, pharmacy negligence and consumer products.
